Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Halsi P.S. Case No. 69 of 2004, registered for punishable under Sections 341, 323, 307 of the Indian Penal Code and section 27 of the Arms Act.

The learned counsel for the petitioner has submitted that though there is allegation on the petitioner that he fired on the informant, but the informant has suffered in simple injuries. He has submitted further that the petitioner is a person of clean

Patna High Court CR. MISC. No.24015 of 2022(2) dt.12-10-2022 2/2 antecedent and the members of prosecution side are accused in the murder case of the father of the petitioner. The petitioner had come from Delhi where he is working to furnish his statement in that case and he has falsely been implicated in this case. Considering the above-mentioned facts and circumstances and also considering the clean antecedent of the petitioner, let him, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Lakhisarai in connection with Halsi P.S. Case No. 69 of 2004, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
