Petitioner seeks regular bail in a case registered for the offence punishable under Section 384, 386 of the Indian Penal Code.

As per the prosecution case, extortion of Rs. 10 lakh was demanded from the mobile phone of this petitioner. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case only on suspicion. Though, it is alleged that extortion money was demanded but the same has not been delivered, as such, no case u/s 386 of the IPC is made out against this petitioner. Petitioner claims clean antecedent and is in custody

Patna High Court CR. MISC. No.31988 of 2021(2) dt.06-01-2022 2/2 since 17.02.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case, the period of custody and clean antecedent of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, West Champaran, Bettiah in connection with Shikarpur PS case No.99/2021.
