The petitioner is in custody in connection with Mahindwara P.S. Case No. 04 of 2023 for the offence under Sections 363, 366A, 34 of the Indian Penal Code and Section 8 of POCSO Act.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 12.01.2023.

As per the F.I.R, on 10.01.2023, informant's minor daughter aged about 13 years was kidnapped by petitioner's sons including petitioner.

The victim girl has been recovered and she in her statement recorded under Section 164 of Cr.P.C has stated no

Considering the fact that the petitioner has got no criminal antecedent and period of custody, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Addl.
