JUSTICE SUDHIR SINGH ORAL ORDER 12-07-2016 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner is apprehending his arrest in connection with Sikandra P.S. Case No. 27 of 2016 for the offences instituted under Sections 323, 341, 504, 506, 307 and 354/34 of the IPC. The accusation is of outraging the modesty of the minor daughter of the informant by the petitioner. When the informant protested, co-accused Amir Yadav tied towel on her neck and pulled with intention to kill and this petitioner assaulted the informant causing rod injury on her head, left shoulder and waist. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It has been alleged that the petitioner assaulted the informant on the head and on the
Patna High Court Cr.Misc. No.27453 of 2016 (2) dt.12-07-2016 2/2 shoulder. From perusal of the injury report, it appears that there is no injury on the head. The injury report do not support the allegations made in the F.I.R. The petitioner has been made accused in the present case due to village politics. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Sikandra P.S. Case No. 27/2016 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Jamui, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
