JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 30-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Kotwali P.S. Case No. 110 of 2018 (NDPS No. 4 of 2018) for the offence under Sections 8/20 (b) (ii) of the N.D.P.S. Act. In the instant case 3.700 kg Ganja was seized from the dickey of the motorcycle.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 02.04.2018. He further submits that the Ganja was recovered from Indradeo Yadav and not from this petitioner. Considering the fact that the petitioner has got no criminal antecedent and also the fact that the petitioner has remained in custody for nearly nine months in connection with seizure of 3.700 kg Ganja, the petitioner, named above, is
