The petitioner apprehends his arrest in connection with Pipra P. S. Case No. 11 of 2017 instituted under Sections 147, 148, 149, 188, 323, 307, 337, 338, 427, 353, 283, and 504 of the Indian Penal Code.
The allegation, in brief, is that a large number of people about 500-600, keeping the dead body of Raj Kapoor Thakur @ Tuntun Thakur, blocked the road and some accused persons blocked the railway line. The police tried to persuade them to lift the blocate then the mob reached to the police station and damaged its gate and also assaulted police officials posted there.
Patna High Court Cr.Misc. No.29078 of 2017 (2) dt.13-07-2017 2/2 It is submitted that the petitioner is a member of a political party and he had informed the police about the incident and there is general and omnibus allegation against all the accused persons.
Having considered the specific allegation against the petitioner of assault to police officials as well as the criminal antecedent, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail is rejected. However, if the petitioner surrenders in the court below and seeks regular bail, the same shall be considered on its own merit without being prejudiced by this order. (Arun Kumar, J) Sujit/- U
