Heard learned counsel for the parties.
This application for anticipatory bail arises out of Aurangabad Complaint Case No. 600 of 2018, disclosing the offence under Sections 323, 498-A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.
The petitioner is husband of opposite party no. 2. There is allegation in the complaint petition of demand of dowry and torture therefor.
Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.21310 of 2020(4) dt.05-12-2020 2/3 petitioner has submitted that it is purely a matrimonial dispute which has given rise to filing of complaint petition. He has submitted that the petitioner is ready to take all possible steps to resume relationship with opposite party no. 2 and live together with love and mutual respect. Considering the fact that this anticipatory bail arises out of a complaint case and the submission advanced on behalf of the petitioner as noted above, this application is allowed. Let the petitioner, above-named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in Aurangabad Complaint Case No. 600 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
