1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406, 420 and 34 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that he wanted to marry and in this regard he was talking with one Ramlal for an year and Ramlal gave him mobile number of one Mithun Mandal (petitioner) who used to talk to the informant regarding his marriage for the last one year, it is next alleged that on 27.06.2021 the informant came to Bhagalpur with his brothers and on 01.07.2021 he married one
Patna High Court CR. MISC. No.23611 of 2023(2) dt.14-07-2023 2/3 Rubi Devi in Sachin Hotel at Kahalgaon who was well known to Ram Pukar who is friend of Mithun Mandal, it is next alleged that for his marriage he had given Rs. 1,00,000/- to Ram Pukar and also spent Rs. 50,000/- in the ceremony and had also given gold and silver to his wife Rubi Kumari but after marriage all the accused persons including the wife and the ladies who had participated in the marriage fled with the cash and ornaments.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that from bare perusal of the allegation as alleged in the FIR, it would manifest that informant himself alleges that he was talking to Ram Pukar and it was Ram Pukar who had given the name and number of this petitioner and this petitioner also talked with the informant regarding his marriage, it is next submitted that even Rs. 1,00,000/- was given to Ram Pukar and petitioner being his friend has been implicated.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on
Patna High Court CR. MISC. No.23611 of 2023(2) dt.14-07-2023 3/3 anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Sabour P.S. Case No. 170 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
