This application for regular bail arises out of Rivilganj P.S. Case No. 112 of 2020, disclosing offences punishable under Sections 399 and 402 of the Indian Penal Code and Section 25 (1-b)a, 26, and 35 of the Arms Act. It is alleged in the F.I.R. that five named criminals were assaulted by the police on secret information, that they were planning to commit dacoity. Three of them were apprehended, whereas two of them managed to sneak away. From the petitioner's possession, allegedly one dagger and a cellular phone was recovered.

Learned counsel appearing on behalf of the petitioner has submitted that the petitioner is in custody since 09.04.2020

Patna High Court CR. MISC. No.21316 of 2020(2) dt.01-07-2020 2/2 and he has been allowed bail in other cases, in which, he has been implicated.

Considering the nature of allegation as alleged in the F.I.R. and the period for which, the petitioner has remained in custody, this application is allowed.

Let the petitioners above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Rivilganj P.S. Case No. 112 of 2020.
