Petitioner seeks bail in connection with Barahara P.S. Case no. 467 of 2019 registered for the offence punishable under sections 365, 302, 201 and 120B of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is in custody since 2.1.2020, is person with clean antecedent and charge sheet has been submitted. Learned counsel submits that the petitioner is innocent and has been falsely implicated in the present case, the name of the petitioner transpired in the confessional statement of co-accused, learned counsel further submits that para 14 of the case diary is based on
Patna High Court CR. MISC. No.32307 of 2021(3) dt.23-12-2021 2/2 confessional statement of this petitioner, knife which was used in the commission of offence was recovered at the instance of the petitioner but from para 15 of the case diary, it would manifest that other co-accused have disclosed about said knife and co-accused Rahul Kumar and two others have been granted bail vide order dated 1.3.2021 in Cr. Misc. no.30667/2020. Learned APP opposes the prayer for bail.
Considering the facts that petitioner is in jail custody, is person with clean antecedent, charge sheet has been submitted and co-accused have been granted bail, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in Barahara P.S. Case no. 467 of 2019 with condition that father of the petitioner shall be one of the bailers. (Satyavrat Verma, J) s.hassan/- U T
