====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 24-04-2024 Heard Mr. Mukul Kumari, learned counsel appearing on behalf of the petitioner and Mr. Ajit Kumar, learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Navinagar P.S. Case No. 413 of 2023 registered for the offence punishable under Sections 147, 148, 149, 323, 325, 427, 448, 337, 504, 506 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the allegation made in the F.I.R., two groups on the occasion of Durga Pooja had entered into fierce fight in which specific allegation of attacking is against one Anshu Kumar who had opened fire on the informant and Raushan Kumar assaulted with iron rod on his hand. General and omnibus allegation has been alleged against other co-accused as they have pelted stones and brick on the house of the informant

4. Learned counsel appearing on behalf of the petitioner submitted that the petitioner is innocent and has falsely been implicated in the case. The allegation levelled against the petitioner is not specific. Specific allegation of assault is against other two co-accused namely Anshu Kumar and Raushan Kumar. The petitioner has clean antecedent.

5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner.

6. Considering the nature of allegation being general and omnibus against the petitioner, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-I, Aurangabad in connection with Navinagar P.S. Case No. 413 of 2023, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
