====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR SINHA ORAL ORDER 01-05-2025 Heard learned counsel for the petitioner and learned A.P.P. the State .

2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 126(2), 115(2), 117(2), 109, 303(2), 351(2), 352, 3(5) of BNS, 2023. 3 . The prosecution story in brief is that on 15-092024 at 6:30 p.m., informant's brother Rajesh Yadav was sitting on the door. Suddenly all the accused persons named in the FIR along with the petitioner came with iron rod, lathi and assaulted the informant's brother Rajesh Yadav with fist and slaps. It is further alleged that Pankaj Yadav, Sunil Yadav ( petitioner) assaulted by fist and slaps on the mouth, nose and eyes of the informant's brother. It is also alleged that the accused persons

Learned counsel for the petitioner submits that there is no major allegation against the petitioner and the only allegation against him in the FIR is of assaulting the informant's brother by fist and slaps on the mouth, nose and eyes. The learned counsel for the petitioner further contends that there is a history of dispute between the two families for which a counter case is also existing (Annexure P/2 to the bail petition) by the family of the petitioner against the family of the informant. Given the history of dispute between the two families, the petitioner has been falsely implicated in the present case which is to teach him and his family members a lesson. 5 . Learned A.P.P. for the State opposed the bail petition.

6. Considering the fact that there is no major allegation against the petitioner, this Court is of the view that the petitioner deserves to be granted the privilege of anticipatory bail, the petitioner in the event of his arrest or surrender within four weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Gaya in connection
