JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-06-2015 Heard learned counsels for the petitioner and the State. The petitioner being the then Branch Manager of Mamrakhabad Branch of Punjab National Bank is apprehending arrest in a case registered for the offences punishable under Sections 409, 420 and 120B of the Indian Penal Code. The prosecution case is that the informant received a notice from the bank with regard to recovery of loan amount of `1,00,000/- sanctioned in the name of Peru Mahto alleged to be the son of the informant whereas the informant has no son, hence it was suspected that the Circle Officer, Pandarak along with the others and the Bank Manager fraudulently got the loan sanctioned to someone.

It is submitted by learned counsel for the petitioner that technical sanction of the loan was made by the petitioner on the

Patna High Court Cr.Misc. No.34687 of 2014 (5) dt.22-06-2015 2/2 basis of land possession certificate issued by the Circle Officer and proper verification was made by the Agriculture Officer. Though, it was the stand of the petitioner before the learned court below that loan was not sanctioned to Peru Mahto but it is submitted by learned counsel for the petitioner that it is an error of record as the loan was sanctioned in the name of Peru Mahto and the voter identity card of Peru Mahto has been brought on record as Annexure-4 which suggests that Peru Mahto is the son of the informant.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Barh, Patna in connection with Pandarak P.S. Case No. 104 of 2011, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
