JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 13-06-2017 Heard learned counsel for the petitioners as well as learned APP for the State.

The petitioners apprehend their arrest in Silao P. S. Case No. 27 of 2017 registered for the offences under Sections 147, 149, 353, 307, 504, 337 and 332 of the Indian Penal Code. As per the prosecution case, following the death of a child in a road accident met by a bus, villagers including the petitioners congregated at the accident site, blocked the road, pelted stones and also assaulted the police personnel inflicting injury to them. Petitioners are said to have been identified in the footage of the photography made on accident site.

Patna High Court Cr.Misc. No.18924 of 2017 (3) dt.13-06-2017 2/2 It is submitted by learned counsel for the petitioners that the petitioners are innocent and they have committed no offence. They have been falsely implicated in the case. They are merely member of the mob. There is no specific allegation against the petitioners rather it is omnibus and general in nature. Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateIV, Nalanda at Biharsharif in Silao P. S. Case No. 27 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
