The petitioners have renewed their prayer for bail in connection with Dhoraiya P.S. Case No. 105 of 2019 registered for the offences punishable under Sections 147, 148, 149, 307, 504 and 506 of the Indian Penal Code.

The prayer for bail of the petitioners was earlier rejected by this Court vide order dated 04.12.2019 granting them liberty to renew their prayer for bail before the court below after the case is committed to the court of session and the charges are framed.

No.21350 of 2020(2) dt.10-03-2021 2/2 Learned counsel for the petitioners submitted that on 23.12.2019 charges under Sections 307/149 of the Indian Penal Code were framed against the petitioners. Thereafter, the petitioners moved for bail before the court below and the same was rejected vide order dated 03.03.2020. He contended that by now the petitioners have remained in custody for over one year and nine months and there is no likelihood of the trial to be concluded in near future.

Considering the nature of the offence and the period undergone by the petitioners in custody as also the observations made by this Court vide order dated 04.12.2019, the petitioners are directed to be released on bail, on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of Fast Track Court-II, Banka in connection with Dhoraiya P.S.
