The petitioner seeks bail in anticipation of his arrest in connection with Kargahar P.S. Case No. 33 of 2020, dated 15.02.2020, instituted for the offences under Sections 147, 148, 149, 323, 341, 342, 338, 427, 307, 353, 504 and 506 of the Indian Penal Code.
The accusation against the petitioner and others is of preventing the police party from discharging their job of
Patna High Court CR. MISC. No.35644 of 2021(2) dt.21-01-2022 2/2 getting the encroachment removed.
It has been submitted on behalf of the petitioner that several others, similarly situated, have been granted anticipatory bail by a Bench of this Court vide order dated 05.03.2021 passed in Cr. Misc. No. 31878 of 2020. Regard being had to the facts afore-stated and taking into account the fact that nothing specific has been alleged against the petitioner, he, in the event of his arrest or surrender before the learned Court below within a period of four weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Sasaram, Rohtas in connection with Kargahar P.S. Case No. 33 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
The application stands allowed.
