The petitioner apprehends his arrest in connection with Manpur P.S. Case No. 66 of 2014 registered for the offences under Sections 448, 341, 323, 337, 385, 354B, 379, 504/34 of the Indian Penal Code.
Prosecution case against the petitioner is that at the instigation of the petitioner his associate Diwakar Raut tore the blouse of the informant and misbehaved with her and also assaulted her by means of brickbat. He also snatched her belongings.
It is submitted by learned counsel for the petitioner that
Patna High Court Cr.Misc. No.19191 of 2017 (2) dt.13-06-2017 2/2 the petitioner is quite innocent and has committed no offence and he has falsely been implicated in the case. The petitioner is only the order giver. The occurrence is said to have been committed on 1.10.2014, but the F.I.R. has been lodged after abnormal delay on 5.10.2014.
Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. III, Nalanda at Biharsharif in connection with Manpur P.S.
