ANJANA MISHRA ORAL ORDER 16-12-2016 Heard learned counsel for the petitioner and the learned counsel for O.P. No.2 as well as the learned counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in connection with Complaint Case No.2949(C) of 2014 for allegedly having committed the offence under Section 420 of the Indian Penal Code and Section 138 of the N.I. Act. It appears from the averments made in the complaint petition that there are glaring discrepancies and there is a bona fide dispute between the parties with regard to the sale and purchase of the land.

No.26490 of 2016 (4) dt.16-12-2016 2/2 Considering the aforementioned facts and circumstances and that now the mediation has failed, though the petitioner was willing to mediate the matter, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur, in connection with Complaint Case No.2949(C) of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
