JUSTICE PURNENDU SINGH ORAL ORDER 07-08-2023 Heard Mr. Devi Das Srivastava, learned counsel appearing on behalf of the petitioner, Mr. Raj Nandan Prasad, learned counsel appearing on behalf of the Accountant General (Bihar) and Mr. Manoj Kumar, learned AC to GP 4 for the State.

Learned counsel appearing on behalf of the petitioner informs that all the retiral dues, as claimed by the petitioner in the present writ petition including pension and gratuity, have already been authorized on 31.08.2022 by the Accountant General (Bihar) to be credited in the pension account of the petitioner, however, the Treasury Officer sat tight

Patna High Court CWJC No.5442 of 2023(2) dt.07-08-2023 2/2 over the matter by not crediting the amount in the pension account of the petitioner for nearly a period of one year.

3. This Court deprecates the manner in which the Treasury Officer sat tight over the matter of payment of pensionary benefit to the petitioner for a period of one year.

4. Considering the facts of the case, the concerned Treasury Officer is directed to forthwith credit all the amount admissible to the petitioner in accordance with law in the account of the petitioner within a period of 2-3 days. In case, the Treasury Officer fails to credit the pensionary benefit into the account of the petitioner within a period of 2-3 days, this Court will take legal action against him.

5. With above observation/direction, the present writ petition is disposed of.
