JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2019 The petitioner apprehends his arrest in connection with Shankarpur P.S.Case No. 110 of 2018 registered under Sections 135 of the Electricity Act, 2003.
Allegation against the petitioner is of committing theft of the electrical energy causing loss of Rs. 2,81,538.00 to the North Bihar Power Distribution Company.
Submission of learned counsel for the petitioner is that petitioner has falsely been implicated in this case as a matter of fact he is running a welding shop through generator. Heard learned APP also. Nobody appears on behalf of the company.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant
Patna High Court Cr.Misc. No.1125 of 2019(2) dt.17-01-2019 2/2 anticipatory bail to the petitioner. However, if petitioner surrenders within a period of six weeks and deposits 50% of the loss amount in two or three installment, the court below shall release the petitioner on provisional bail on payment of first instalment of Rs. 50,000/- and once rest amount, after his release on provisional bail, is deposited by him within a period of six months, his provisional bail shall be confirmed. Needless to say that the amount, so deposited by the petitioner, shall be subject matter to the result of the case. Accordingly, the application stands disposed of. (Vinod Kumar Sinha, J) sujit/- U T
