ANJANA MISHRA ORAL ORDER 17-09-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Birpur P.S. Case No. 54 of 2016 registered for the offences punishable under Section 409 of the Indian Penal Code. Earlier the petitioners were directed to appear with all documents before the Block Education Officer as per the supplementary affidavit filed today, in which, it is stated that they have appeared before the Blok Education Officer on 18.08.2016 and filed their written application.

It is submitted on behalf of the petitioners that the

Patna High Court Cr.Misc. No.26708 of 2016 (6) dt.17-09-2016 2/2 report sought for by this Court, has not yet been sent from the Block Education Officer till date and similarly situated co-accused persons have been extended the privilege of anticipatory bail in Criminal Miscellaneous No. 25472 of 2016 vide order dated 23.06.2016 and also in Criminal Miscellaneous No. 25662 of 2016 on 29.06.2016. The petitioners are similarly situated persons and, thus, they may be extended the privilege of anticipatory bail also.

Having considered all the facts and circumstances of the case and the fact that the petitioners stands similarly situated as the co-accused persons, let the above named petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Birpur, Supaul in connection with Birpur P.S. Case No. 54 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
