====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 24-05-2022 Heard learned counsel for the petitioner and learned counsel for the State.

Learned counsel for the petitioner is directed to remove the defects, as pointed out by the office, within a period of four weeks.

The petitioner is apprehending his arrest in connection with Chirayia P.S. Case No. 277 of 2020 registered for the offence under Sections 341, 323, 450, 379, 307 and 504/34 of the I.P.C.

The prosecution story, in brief, is that on 29.09.2020 at about 7.00 P.M., in the evening, the petitioner and other coaccused came at the shop of the informant and demanded Rs.

Patna High Court CR. MISC. No.36098 of 2021(2) dt.24-05-2022 2/3 10,000/- as ransom for not giving the goods on credit. On refusal, they assaulted the informant with Lathi and Dabila on her head. The accused persons also took cash Rs. 40,000/- and gold Jitia. The informant sustained injury and thereafter she was admitted to Chiraiya Hospital and from there she was referred to Sadar Hospital at Motihari.

It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. He has falsely been implicated in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. There is no allegation of assault alleged against the petitioner. The petitioner is alleged to be an order giver. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances of the case, let the petitioner above named, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 4th, Sikarahana at Dhaka, East Champaran, in connection with Chirayia P.S.
