15-10-2015 Heard Md. Anis Akhtar, learned counsel for petitioners and learned Addl. Public Prosecutor. Three petitioners, apprehending their arrest in Excise Case No. 27 of 2015 registered for the offence under Section 47(A) of the Excise Act, have prayed for grant of anticipatory bail. It was submitted by learned counsel for petitioners that it has been alleged that near the house of the petitioners, about fifty litres country-made liquor was recovered and it has been alleged that petitioners were involved in the said occurrence. I have perused the materials on record.
In view of the facts and circumstances, let the
Patna High Court Cr.Misc. No.47668 of 2015 (2) dt.15-10-2015 2/2 petitioners namely Vyash Rai, Subhas Rai and Santosh Rai be enlarged on bail, in the event of their arrest or surrender within a period of eight weeks from today, on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari (East Champaran)/concerned court in connection with Excise Case No. 27 of 2015, subject to condition as laid down under Section 438(2) of the Cr.P.C.
