2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 74, 109, 303 , 191 ( 2 ), 191 (3) ,329 ( 4 ), 126 ( 2 ), 324 (5) , 115 , 117(2) of BNS. 3 . As per the prosecution case , on the alleged date and time of occurrence , all the F.I.R., named accused persons including this petitioner armed with lathi, danda assaulted informant and his family members.
4. It is submitted on behalf of the petitioners that both parties are neighbours and due to dispute over digging soak pit, a simple occurrence of maarpeet took place between them. Allegation of assault is general and omnibus. No specific overt act has been alleged against this petitioner. Petitioner claims

5 . Learned counsel for the State opposed the bail petition .
6 Considering the general and omnibus allegation of assault against this petitioner, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned JM 1st Class (West ) Muzzaffarpur in connection with Karza P.S. Case No. 254 of 2024 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 . (Prabhat Kumar Singh, J) Koushik/- U T
