02. In the present case, the petitioner seeks bail in connection with Mufassil P.S. Case No. 12 of 2025 registered on 04.01.2024, for the alleged offences under Sections 121, 190, 126(2), 115(2), 119, 308(2), 352, 351(2) of Bharatiya Nyaya Sanhita, 2023.

03. As per prosecution case, petitioner and other coaccused persons stopped the four-wheeler of the informant and the petitioner told him that the informant failed to make the payment of installment and thereafter, the informant made payment of Rs. 14,400/- in the account of Mahindra Finance. Subsequently, the petitioner and other forced the informant to

04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. From the allegation in the FIR, it appears the occurrence took place in the backdrop of the informant not making payment to the finance company. From the FIR, it appears that except for asking the informant to make payment and subsequently, the informant making payment, there is no further allegation against the petitioner. Though allegation is also of assault, but there is no injury report. The petitioner has been made accused in this case due to his criminal antecedent as he is having antecedent of three case. The petitioner is in custody since 10.01.2025 and charge-sheet has been submitted.

05. Learned APP for the State opposes the prayer for bail.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner along with submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the

Patna High Court CR. MISC. No.23390 of 2025(2) dt.02-05-2025 3/3 satisfaction of learned Chief Judicial Magistrate, Motihari/court concerned in connection with Muffasil P.S. Case No. 12 of 2025, subject to the conditions mentioned in Section 480(3) of BNSS and the following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
