The petitioners apprehend their arrest in connection with Darauli P. S. Case No. 121 of 2016 instituted under Sections 304B and 201/34 of the Indian Penal Code.

The allegation, in brief, is that deceased was married with the son of the petitioners in 2014 and thereafter further demand of dowry was made, but when demand was not fulfilled, her body was set on fire and she was taken to Gorakhpur Medical College but succumbed to injury.

Learned counsel for the petitioners submits that the petitioners are father-in-law and mother-in-law of the deceased and the allegation of setting her on fire is false and fabricated rather it was a case of accidental burning and the statement of the

Patna High Court Cr.Misc. No.20592 of 2017 (2) dt.13-06-2017 2/2 victim was also recorded in the hospital and a certificate of the doctor was given that she is fit for statement, wherein she admits of accidental burn injury.

Having considered the aforesaid facts and circumstances, let the petitioners, namely, Surendra Yadav @ Surendra Chaudhary and Kaushalaya Devi, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri A.Pandey, learned Judicial Magistrate-1st Class, Siwan in connection with Darauli P.S.Case No.121 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
