JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with NDPS Case No. 59 of 2018, arising out of Bodh Gaya P.S. Case No. 640 of 2018, for the offence under Sections 8, 20, 22, 25, 27 of the N.D.P.S. Act.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 06.11.2018.

In the instant case 150 Gram Ganja was recovered from the room of the petitioner. He submits that the quantity of the Ganja was small one. He further submits that the petitioner is neither the owner of the house nor the tenant of the house of Ranjeet Kumar. He submits that the house of the petitioner is situated besides the house of Ranjeet Kumar, who is alleged to

Considering the fact that the petitioner has got no criminal antecedent and the quantity of Ganja is small one, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge (NDPS Act), Gaya in connection with NDPS Case No. 59 of 2018, arising out of Bodh Gaya P.S. Case No. 640 of 2018.
