JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-06-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. At the very outset, it is pointed out on behalf of the petitioners that the petitioner No. 1 namely, Sanjay Prasad has already been arrested.
Accordingly, prayer for anticipatory bail of the petitioner No. 1 namely, Sanjay Prasad stands dismissed being infructuous. So far as petitioner No. 2 is concerned; he apprehends his arrest in connection with Madanpur P.S. Case No. 65 of 2014 registered under Sections-324, 307 & other minor sections of the Indian Penal Code.
The allegation against the petitioner No. 2 is that he along
Patna High Court Cr.Misc. No.48415 of 2014 (3) dt.22-06-2015 2/2 with Sanjay Mahto assaulted the injured, Manish Kumar and Ajay Kumar with iron rod. The injured Ajay Kumar and Manish Kumar sustained injuries but it appears that all the aforesaid injuries were found to be simple in nature. Moreover, persons from both the sides, sustained injury and the alleged occurrence took place on account of land dispute.
Considering the aforesaid submission and facts and circumstances of the case, let the petitioner No. 2 namely Jagnarayan Prasad, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of the order in the court below, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Madanpur P.S. Case No. 65 of 2014 to the satisfaction of Learned Chief Judicial Magistrate, Aurangabad subject to conditions as laid down u/S 438(2) of the Code of Criminal Procedure.
