JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

It is alleged that the petitioner was interested in purchase of the land of the informant but the informant sold the land to some other person, hence, the petitioner and other accused persons threatened the informant. Subsequently, the informant's tractor was stolen, hence the suspicion was raised against the petitioner.

It is submitted by the learned counsel for the petitioner that only on suspicion the accusation has been levelled when one Md. Akhtar Ansari in Barauli P.S. Case No. 82 of 2013 confessed

Patna High Court Cr.Misc. No.52126 of 2014 (5) dt.22-06-2015 that he committed theft of tractor of the informant and sold the same to some other person.

Considering the suspicious nature of accusation and confession of Md. Akhtar Ansari that he committed theft of the tractor of the informant, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gopalganj in connection with Barauli P.S. Case No.37 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
