08-12-2021 At the outset, learned counsel for the petitioners seeks permission to make correction in paragraph - 6 of the bail petition.

Permission is accorded. It may be done in course of the day.

Heard learned counsel for the parties.

The petitioners seek bail in Excise Case No. 484 of 2021, arising out of Dhangai P.S. Case No. 25 of 2021, registered for the offence under Sections 272 / 273 of the I.P.C. and Section 30(a) of Bihar Prohibition and Excise Act. 141 liters & 250 ml. of illicit liquor has been recovered from the house of the petitioner no. 1 and both petitioners were arrested on spot.

Patna High Court CR. MISC. No.35215 of 2021(2) dt.08-12-2021 2/2 It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioners. The recovery has been made from the house, which is in joint possession of the family. Petitioners has got clean antecedent and they are in custody since 08.03.2021. Investigation is complete.

Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation and period of custody, the bail petition of petitioners is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge Excise Act, Bhojpur at Ara in connection with Excise Case No. 484 of 2021, arising out of Dhangai P.S.
