JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 30-10-2023 Heard Mr. Shashi Bhushan Singh, learned counsel appearing on behalf of the petitioner; Mr. Prabhakar Jha, learned GP-27 along with Mr. Shankar Kumar Thakur, learned AC to GP-27 for the State and Mr. Nadim Seraj, learned counsel along with Mr. Iqbal Asif Niazi, learned counsel for the Lalit Narayan Mithila University, Darbhanga.

2. Mr. Nadim Seraj, learned counsel appearing on behalf of the University informs this Court that during pendency

Patna High Court CWJC No.5983 of 2023 dt.30-10-2023 2/3 of the writ petition, petitioner has been paid due retiral benefits under different heads and a communication has been sent to the Sr. Treasury Officer, Darbhanga vide Memo No. A/C/2358/23 dated 06.10.2023.

3. Considering the aforesaid information given on behalf of the University, Sr. Treasury Officer, Darbhanga is directed to ensure that the amount is credited into the pensionary bank account of the petitioner forthwith today.

4. In case of failure, he will be liable to make payment of Rs.5000/- as fine from his own pocket which is required to be deposited with the District Legal Services Authority.

5. Learned counsel appearing on behalf of the petitioner submits that certain dues are still required to be paid in light of the judgment dated 06.10.2021 passed in C.W.J.C. No. 6672 of 2019 (Devata Devi Vs. The State of Bihar and Ors.). Petitioner has placed reliance particularly with respect to the direction made in Para-8 of the said judgment.

6. The petitioner, if so advised, may file a detailed representation before the Registrar of the Lalit Narayan Mithila University. If the petitioner is found entitled, the claimed dues is directed to be paid within a period of six weeks from the date of

Patna High Court CWJC No.5983 of 2023 dt.30-10-2023 3/3 passing of this order.

7. With the aforesaid observation and direction, the writ petition stands disposed of.
