JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-01-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 394 of the Indian Penal Code. Petitioner is named in the first information report but having similar allegation, co-accused Chhotu Kumar Choudhary has already been granted privilege of bail by a co-ordinate Bench of this court vide order dated 08.03.2018 passed in Cr. Misc. No. 60261 of 2017. Moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 09.10.2018.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above

Patna High Court Cr.Misc. No.78720 of 2018(2) dt.18-01-2019 2/2 named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Begusarai in connection with Sahebpur Kamal P.S. Case No. 237 of 2016.
