2. The petitioner has preferred this application for grant of regular bail in connection with Sarai Ranjan P.S. Case No. 175 of 2024 registered for the offences punishable under Section 309(4) of the B.N.S, 2023 but the same was deleted and Sections 310(2), 317(3) of the B.N.S, 2023 was added vide order dated 08.01.2025.
3. As per the prosecution story, the informant is the driver of the pick-up vehicle which belong to 'Ambika Bhawani Traders', bearing Regd. No. BR-01GN/7374. It is further alleged that on 13.12.2024 at about 06:00 PM, he proceeded from Patna to Madhepura along with pick-up vehicle on which, 130 bundle of pumplets were loaded and as soon as he reached at
Patna High Court CR. MISC. No.22417 of 2025(2) dt.28-04-2025 2/3 Dalsinghsarai at 10:00 P.M., one Apache Motorcycle and one white colored Scorpio vehicle stopped the vehicle of the informant and two unknown persons riding on the Motorcycle, pointed pistol on the informant, assaulted and took his mobile phone and Pick-up vehicle and thereafter fled away towards Dalsinghsarai. Anyhow, the informant informed the police station and the owner of the said vehicle.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is also submitted that the petitioner is not named in the FIR. He further submits that the petitioner has not committed any offence rather he has been made victim of the atrocities of the police personnel in conspired manner with the present informant. No T.I. Parade was conducted till date. One of the co-accused person namely, Rajnish Puri has been granted bail by Co-ordinate Bench of this Court in Cr. Misc. No. 24368 of 2025. Moreover, the petitioner is languishing in judicial custody since 15.12.2024.
5. Learned A.P.P. appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.
6. Considering the aforesaid facts and the period under custody, let the petitioner, above named, be released on
Patna High Court CR. MISC. No.22417 of 2025(2) dt.28-04-2025 3/3 bail after framing of charge on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Samastipur in connection with Sarai Ranjan P.S. Case No. 175 of 2024, subject to following conditions:- (i) one of the bailor should be the family member/relative of the petitioner.
(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself.
