ANJANA MISHRA ORAL ORDER 22-01-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in Barbigha P.S. Case No. 211/2015, registered for the offences punishable under Sections 448, 323, 504, 506, 380, 307/34 of the Indian Penal Code.
Case diary of the present case was called for which has also been received.
Learned counsel for the petitioner submits that though the allegation of mar-pit against other accused persons, the only allegation saddled on the petitioner is of taking away of Rs. 50,000/- from the Godrej almirah of the informant. He further submits that so far as the present allegation is concerned it is
Patna High Court Cr.Misc. No.47606 of 2015 (4) dt.22-01-2016 2/2 ornamental and no further material has shown in the case-diary to support this fact.
Learned counsel for the State, after perusal of the casediary, submits that the allegation of mar-pit is not against the petitioner except the allegation of taking away of Rs. 50,000/-. Save and except this fact, there is no further cogent material against the petitioner.
Considering the facts above noted and that the petitioner has no criminal antecedent, let the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sheikhpura in connection with Barbigha P.S. Case No. 211/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
