ANJANA MISHRA ORAL ORDER 14-01-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in connection with Bidupur P.S. Case No. 111 of 2015, registered for offences punishable under Sections 147, 148, 149, 341, 323, 324, 325, 307 and 379 of the Indian Penal Code.
Learned counsel for the petitioner submits that the present case arises out of an occurrence in which both parties had an altercation and there is a case and counter case between the parties. In Bidupur P.S. Case No. 129 of 2015, it has been alleged by the brother of the present petitioner that injuries have also been sustained by his brother as well as this petitioner. Considering the fact that there is series of litigation
Patna High Court Cr.Misc. No.48589 of 2015 (2) dt.14-01-2016 2/2 between the parties and also they are co-villagers and F.I.R bearing Bidupur P.S. Case No. 129 of 2015 has been lodged in the Sadar Hospital by these petitioners (annexure -2) in which other accused persons have been extended the privilege of anticipatory bail and also because the petitioner has sustained similar injuries, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 111 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
