16-01-2019 Heard Sri Dhirendra Nath Jha, learned counsel assisted by Sri Amrendra Kumar Jha, learned counsel for the petitioner and Sri Madan Kumar, learned Addl. Public Prosecutor.

The petitioner, who is in custody in Kotwali (Barari) P.S. Case No. 231 of 2018 (G.R. No. 1607/18) registered for offence under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act, 1959, has filed the present petition for grant of bail in a very short span of time from the earlier rejection of bail. Only on 20-08-2018, vide Cr. Misc. No. 49902 of 2018, the prayer for bail of the petitioner was rejected, considering the ground that deceased was intercepted by altogether 10 accused persons and indiscriminate firing was

Patna High Court Cr.Misc. No.77403 of 2018(2) dt.16-01-2019 2/2 made.

Learned counsel for the petitioner submits that during further investigation, supplementary chargesheet was submitted and in supplementary chargesheet, accusation was made against two accused persons. Meaning thereby that at least, no material has been found against the petitioner.

Fact remains that on merit, the prayer for bail of petitioner was rejected recently and as such, there is no reason to again consider the prayer for bail.

The prayer for bail again stands dismissed.
