The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 33 of the Forest Act.
The prosecution case is that the petitioner constructed a house on the forest land and was selling the forest land.
It is submitted by the learned counsel for the petitioner that petitioner purchased the land from Madhusudan Yadav in the name of his wife, consequently his name was mutated and considering the fact that the State Government also treated the land in question as non-forest land and order of mutation was passed by the officer of the State Government,
Patna High Court Cr.Misc. No.48144 of 2015 (2) dt.05-11-2015 the wife of the petitioner has been granted anticipatory bail by learned Sessions Judge, Gaya.
Considering the fact that the land in question is registered in the name of the wife of the petitioner and statement has been made in para-3 of the petition that petitioner has no criminal antecedent, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Forest Case No. 27 of 2013, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
