The petitioner is apprehending his arrest in connection with Shahpur P.S.Case No.365 of 2018 dated 1.12.2018 registered for offences punishable under Section 379 of the Indian Penal Code.

Allegation against the petitioner is that he has stolen the tempo of the informant.

Submission of the learned counsel for the petitioner is that as a matter of fact there was dispute with respect to wages and he has been falsely implicated in this case as well as he has no criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides and in view of the fact that the petitioner is named in the FIR, I am not inclined to grant

Patna High Court CR. MISC. No.21635 of 2019(2) dt.10-05-2019 2/2 privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and move before the learned court below, who will considered he same on its own merit.

With the aforesaid direction, this application is dismissed.
