Petitioner seeks pre-arrest bail in Bikramganj P.S.Case No.268/18 registered under Sections 272, 273 of I.P.C. and Section 30(a) of Bihar Prohibition and Excise Act. Allegation is of recovery of 18 litres wine from the motorcycle bearing Jharkhand number plate parked behind the Shyam Talkies. Further the petitioner is an accused in one more case.

Submission on behalf of the learned counsel for the petitioner is that he has been falsely implicated in this case. Heard the learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances of the case, I am not inclined to grant privilege of anticipatory bail to the petitioner rather petitioner should

Patna High Court Cr.Misc. No.1343 of 2019(2) dt.19-01-2019 2/2 surrender before the court below and pray for regular bail which will be considered on its own merit without being prejudiced by this order.

Accordingly, this application is dismissed.
