The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 20(B)(ii) and 22 of the Narcotic Drugs and Psychotropic Substances Act. 6.4 Kg of Ganja was recovered from the house of petitioner.

It is submitted that no incriminating article has been recovered from conscious possession of this petitioner. At that time petitioner was elected to the post of Mukhiya and at the instance of his enemies he has been falsely implicated in this case. Petitioner claims clean antecedents.

Counsel for State however vehemently opposed the prayer for bail and submitted that from bare perusal of seizure

Patna High Court CR. MISC. No.24036 of 2023(2) dt.27-06-2023 2/2 list it is apparent that 6.4 Kg of Ganja was recovered from house of this petitioner.

Considering the nature of accusation, I am not inclined to enlarge the petitioner above-named on anticipatory bail in connection with Cheriya Bariyarpur P.S. Case No. 55 of 2022 corresponding to NDPS Case No. 11 of 2022. Accordingly, the same is rejected.
