JUSTICE BIRENDRA KUMAR ORAL ORDER 14-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending her arrest in connection with Sonepur P.S. Case No. 178 of 2017 for the offences punishable under Sections 272, 273 of the Indian Penal Code and 30(A), 35, 41 and 47 of the Bihar Prohibition and Excise Act, 2016.

From the back side of the house of the petitioner, foreign liquor was recovered.

Submission of the learned counsel for the petitioner is that the petitioner is a female and had no knowledge as to who had put the said material behind her house. It is further submitted that she has no criminal antecedent.

Patna High Court Cr.Misc. No.29592 of 2017 (2) dt.14-07-2017 2/2 Let, the petitioner, above named, in the event of her arrest or surrender the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court below/Successor Court in connection with Sonepur P.S. Case No. 178 of 2017 subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. With further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
