Petitioner seeks bail in connection with Sessions Trial No.289(A-1)/14 arising out of Gardanibagh P.S. Case No.118 of 2017 pending before the Court of learned Additional Sessions Judge, XVII, Patna registered for the offences punishable under Sections 302/34 of the Indian Penal Code as well as Section 27 of the Arms Act.

After having gone through the bail rejection order, the period of incarceration, in my opinion, in a heinous offence like murder cannot be taken to be a ground at this stage for grant of bail. Accordingly, the application for bail is rejected. It will be open to the trial Court to abide by the orders passed by this Court earlier.
