This application for anticipatory bail arises out of Koilwar P.S. Case N0. 66 of 2014, disclosing offences under Sections 498A,302/34 of the Indian Penal Code. The petitioner is the mother-in-law of the deceased. Learned counsel appearing on behalf of the petitioner appears to be right in his submission that over and above suspicion as disclosed in the First Information Report, there is no material against the petitioner to show her role in the death of the deceased.
It is submitted that the petitioner shall present himself before the police as and when required and there is no chance that he will tamper with the evidence or influence the witnesses.
Considering the nature of accusation and submissions advanced on behalf of the petitioner, this application is allowed.
Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in Koilwar P.S. Case No. 66 of 2017,G.R. No. 1216 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present herself before the Police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bonds shall be liable to be cancelled.
