====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 09-11-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 448, 341, 323, 324, 325, 307, 354, 379 and 504 read with Section 34 of the Indian Penal Code.
The informant alleges that his father sold land for Rs. 15 lacs for marriage of his cousin sister, the pattidars were demanding Rs. 2 lacs as there share, further, on 14.07.2021, the
Patna High Court CR. MISC. No.23492 of 2022(2) dt.09-11-2022 2/3 petitioners came variously armed and assaulted his family members and looted Rs. 6 lacs on pretext of dispute relating to path.
Learned counsel for the petitioner submits that petitioners are persons with clean antecedent. Learned counsel further submits that from bare perusal of the allegation as alleged in the FIR, it would manifest that on account of dispute relating to share in the sale of land, the present false case came to be instituted as the informant and his family never intended to part with the money which they had received in lieu of sale of the land, it is also submitted that from side of the petitioners, Shikarpur, P.S. Case No. 344 of 2021, has been registered against the informant and his side as such the present case is a counter-blast.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like
