3. As per prosecution case, over some minor altercation, the petitioner shot at the informant causing injury in his chest.
4. The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner has not caused any injury to the informant
Patna High Court CR. MISC. No.24868 of 2026(3) dt.20-07-2026 2/3 and he does not even know the informant. The learned counsel further submits that no serious injury has been caused to the informant as he put his signature on the fardbeyan. The petitioner is young boy aged about 20 years and is having clean antecedent. The petitioner is in custody since 26.10.2025.
5. The learned APP for the State vehemently opposes the submission made on behalf of the petitioner. The learned APP submits that there is direct allegation against the petitioner that he fired upon the informant causing two lacerated wounds on left chest wall and the injury was stated to be grievous caused by firearm. The learned APP further submits that the fardbeyan was recorded a day after the occurrence when the petitioner was operated for the firearm injury in PMCH and putting signature on fardbeyan is quite natural as the informant recovered after operation. The learned APP also submits that prayer for bail of one of the co-accused, namely Aditya Kumar has been rejected by the learned Coordinate Bench of this Court vide order dated 31.03.2026 passed in Cr. Misc. No.19819 of 2026.
6. Having regard to the direct, specific and serious nature of allegation, I am not inclined to enlarge the petitioner on bail.
