====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 13-06-2017 Heard learned counsels for the petitioners and the State.

The petitioners apprehend their arrest in connection with Kamtaul P. S. Case No. 124 of 2016 instituted under Sections 323,341, 420,504 and 506/34 of the Indian Penal Code. The allegation, in brief, is that Md. Wasim @ Parwez, son of petitioner no. 1, approached the informant that he will send his son to Malesiya for work and asked him to pay Rs. 1.2 lack and the informant paid the amount after that, informant's son was sent to Malesiya but he returned back after 13 days because he was sent on Tourist Visa, thus, cheated by the accused persons. It is alleged that a Panchayati was held and these petitioners

Patna High Court Cr.Misc. No.20874 of 2017 (3) dt.13-06-2017 2/2 accepted the fault of Wasim and agreed to return back the money. Learned counsel for the petitioners submits that whatever allegation is made i.e., against Md. Wasim and not against these petitioners and they have been made accused only to put pressure to get back the money and they are father and brothers of Md. Wasim and they are not involved in the alleged occurrence and have no criminal antecedent.

Having considered the aforesaid facts and circumstances, let the petitioners, namely, Ehsanul Haque @ Ehsanul, Md. Jaseem @ Md. Jaseem Parwej and Md. Babar, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Darbhanga in connection with Kamtaul P.S.Case No. 124 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
