Earlier this Court had refused the prayer for regular bail to the petitioner on 31.01.2018 with a direction to the learned trial Judge to conclude the trial within nine months, failing which the petitioner would be at liberty to renew his prayer for bail before the learned Court-below itself. The prayer was refused by the learned Court-below. Hence, the same has been challenged herein.
The report of the learned trial Judge dated 18.02.2019 reveals that charges were framed in the case on 29.01.2018 i.e., more than a year back. However, no prosecution witness has turned up uptil now. The petitioner is
Patna High Court CR. MISC. No.78735 of 2018(3) dt.10-04-2019 2/2 in custody since 04.03.2017.
Allegation is that the petitioner had given a dagger blow at the neck of the brother of the informant as a result whereof the brother died subsequently. The doctor has found sharp cut injury at the neck of the deceased. Considering the period already undergone and the undertaking of the petitioner that he will fully cooperate with the trial as well as the fact that the petitioner has got no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Patrakar Nagar P.S.
