The petitioner is apprehending his arrest in connection with Bihta P.S.Case No.1441 of 2018 registered for offences punishable under Sections 498(A) of the Indian Penal Code. Allegation against the petitioner is of subjecting his wife to be cruelty with respect to demand of dowry and ousting her from the house.

Submission of the learned counsel for the petitioner is that earlier he had lodged a case against the informant and due to that the present case has been lodged and he is still ready to keep her and ready for one time settlement.

Heard learned A.P.P. and the learned counsel for the informant , who has also no objection and she is also ready to reside with the petitioner if she is allowed to live with dignity

Having heard both sides and in view of submission of both the parties, this application is disposed of with direction to the petitioner to surrender before the learned court below within a period of six weeks from the date of order and file a petition before the learned court below that he is ready to keep her and he is taking his wife from the court itself and on filing such application , the petitioner shall be released on provisional bail for a period of six months and during that period the learned court below shall call them in the first week of each month and being satisfied with the conduct and matrimonial relationship of both the parties, he will confirm the bail bond of the petitioner, otherwise he is free to pass any other order or orders as he deems fit and proper.

With the aforesaid observation, this application is disposed of.
