====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 20-01-2022 Heard Mr. Dhramveer, learned Advocate for the petitioner and Mr. Ram Priya Sharan Singh, learned Additional Public Prosecutor for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Darounda P. S. Case No. 225 of 2017 instituted for the offences under Sections 399, 402, 413 and 414 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

The petitioner has been named in the F.I.R., but such name has come in the confession of the arrested accused persons.

The learned counsel for the petitioner has submitted that four accused persons were arrested from whom fire arm weapons and other incriminating articles were recovered. The only material against the petitioner, therefore, is

Though the petitioner was made accused in another case earlier about which reference has been made in Para-3 of the bail petition, but he has been granted bail in that case. Regard being had to the facts afore-stated, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Siwan in connection with Darounda P.S. Case No. 225 of 2017, subject to the condition as laid down under Section 438

(2) Cr. P.C.

The application stands allowed.
