Petitioner seeks bail in S.T. No.217 of 2015 arising out of Baunsi (Bandhua Kuraba) P.S. Case No. 32 of 2015 (G.R. No.597 of 2015) registered for the offence punishable under Sections 302 and 34 of the Indian Penal Code and under Section 27 of the Arms Act.

Informant has alleged that petitioner along with other co-accused has fired upon the father of informant as a result of which he died on the spot.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. Petitioner has got no criminal antecedent and is in custody since 30.06.2017.

Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.78322 of 2018(2) dt.17-01-2019 2/2 the case, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is hereby rejected.

However, trial court is directed to conclude the trial within one year.
